What Does it Mean to be a Protected Veteran?

The protected veteran meaning refers to a legal status that shields eligible former service members from workplace discrimination based on their military service, as defined under the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). 

Originally passed in 1974, it has expanded to cover veterans from various service periods. 

Holding this status means you’re entitled to legal protections against discrimination and may qualify for hiring preferences, transition services, and support programs. 

Am I a Protected Veteran?

VEVRAA considers you a protected veteran if you fit into one of these categories:  

  • Disabled Veteran: You have a VA disability rating of 10% or higher (or who but for the receipt of military retired pay would be entitled to disability compensation) or were discharged due to a service-connected disability.  
  • Recently Separated Veteran: You left active duty within the past three years.  
  • Active-Duty Wartime or Campaign Badge Veteran: You served during a period of war as defined by law, including World War II, the Korean War, the Vietnam era, and the Persian Gulf War (August 2, 1990–present).  
  • Armed Forces Service Medal Veteran: You earned an Armed Forces Service Medal while on active duty (check your DD214 to confirm). 

You must be discharged with a status other than dishonorable to qualify. If your discharge is dishonorable, consider applying for a discharge upgrade.

Protections for Protected Veterans

  • Fair Employment – You can’t be denied employment, fired, or demoted solely because of your veteran status. 
  • A Discrimination-Free Workplace – You have the right to work in an environment free from bias or unfair treatment. 
  • Equal Treatment – You must receive the same opportunities and benefits as non-veteran employees in similar roles. 
  • Fair Compensation – You must receive the same pay as other employees performing the same job.
