How Does Presumptive VA Disability Work?

To qualify for presumptive VA disability, veterans must meet the following:

  • Service in a Qualifying Location: Veterans must have served in areas known for hazardous exposures, such as Vietnam (Agent Orange), Gulf War regions, or areas with burn pits.
  • Specific Time Periods: Service must have occurred during periods when exposures were documented or likely to occur.

3 Types of PACT Act C&P Exams

There are three types of C&P exams for PACT Act related claims depending on the type of exposure:

#1. Burn Pit Exposure:

Veterans exposed to burn pits may develop respiratory conditions such as asthma, chronic bronchitis, or chronic sinusitis. During the C&P exam, the examiner will review medical history, conduct a physical examination, and may order pulmonary function tests to assess lung capacity and function.

#2. Toxic Exposure Risk Activity (TERA):

This category includes veterans involved in activities with a high risk of toxic exposure, such as handling hazardous materials. The C&P exam will evaluate any related health conditions, which may range from skin disorders to neurological issues, depending on the nature of the exposure.

#3. Agent Orange Exposure:

Veterans exposed to Agent Orange are at risk for conditions like hypertension, ischemic heart disease, and certain cancers. The C&P exam will involve a thorough review of medical records, assessment of current symptoms, and may include diagnostic tests to evaluate the presence and severity of these conditions.

What to Expect at a PACT Act C&P Exam

During a PACT Act C&P exam, the examiner will:

  • Review Your Service and Medical History: Discuss your service history and medical records, focusing on the diagnosis and symptoms related to the possible presumptive condition due to exposure.
  • Conduct a Physical Examination: Perform a targeted physical exam to assess the severity of your condition.

Example PACT Act Claim for Presumptive Service Connection

A veteran deployed to Iraq and Afghanistan in 2004 and 2007 was exposed to burn pits used to dispose of waste and chemicals.

After service, they developed persistent nasal congestion, facial pain, post-nasal drip, and frequent sinus infections, leading to a diagnosis of chronic sinusitis.

Filing a PACT Act VA Claim:

The veteran filed a VA disability claim for chronic sinusitis under the PACT Act as a presumptive condition linked to burn pit exposure on VA.gov.

Since the PACT Act presumes service connection for this condition, no further proof of service connection was required.

C&P Exam Process:
