For decades, the U.S. military relied on burn pits to dispose of waste in Iraq, Afghanistan, and other parts of the Southwest Asia theater of operations.

But the toxic smoke and airborne hazards from these pits have left countless veterans battling serious, long-term health conditions.

The good news?

The Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics (PACT) Act of 2022 has ushered in a new era of support for veterans affected by toxic exposure.

This groundbreaking legislation expands VA healthcare and disability benefits, streamlining access for Gulf War-era and post-9/11 veterans to get the compensation and care they’ve rightfully earned.

If you’ve been diagnosed with a condition linked to burn pits and toxic exposure, you may qualify for VA disability benefits under the PACT Act.

In this article, VA disability expert Brian Reese breaks down everything you need to know, including basic eligibility, how presumptive service connection works, the updated list of PACT Act presumptive conditions, the VA claims process for burn pits and toxic exposure, and pro tips and strategies to maximize your VA disability benefits.

Let’s begin!

Summary of Key Points

  • The PACT Act Expands VA Benefits for Toxic Exposure: The Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics (PACT) Act of 2022 has significantly expanded VA healthcare and disability benefits for Gulf War-era and post-9/11 veterans exposed to burn pits and other toxic hazards.
  • Presumptive Service Connection Makes VA Claims Easier: Veterans diagnosed with 23 presumptive conditions related to burn pit exposure no longer need to prove a direct nexus between their illness and military service, streamlining the VA claims process.
  • Eligibility is Based on Service Location and Diagnosis: Veterans qualify if their DD 214 confirms service in designated locations (such as Iraq, Afghanistan, and Southwest Asia) and they have a diagnosed presumptive condition recognized under the PACT Act.
  • How to File a PACT Act Claim and Maximize Your VA Benefits: Veterans can file a PACT Act-related VA claim online, by mail, or with a VA-accredited representative. Pro tips include enrolling in the Burn Pit Registry, tracking your claim on VA.gov, and taking advantage of free VA healthcare for up to 10 years after separation.

What is The PACT Act?

The PACT Act is a law that expands healthcare and disability benefits for veterans who were exposed to toxic substances, like burn pits, during their military service.

It simplifies the process for veterans to receive disability benefits by automatically assuming certain conditions are related to their service, making it easier for them to get the care and compensation they need.

Am I Eligible for VA Disability Benefits for Burn Pit and Toxic Exposure?

You may be eligible for VA disability and healthcare benefits due to burn pits and toxic exposure if:

  • Your DD 214 shows you served on active duty in qualifying locations where burn pits were used.
  • You did not receive a dishonorable discharge.

What is a Presumptive Condition for VA Disability?

A presumptive disability is a condition that the VA automatically assumes is related to a veteran’s military service based on specific circumstances, such as the location and time period of service.

This eliminates the need for the veteran to prove a direct connection, or “nexus,” between their service and the condition they developed, making it easier to qualify for VA disability compensation benefits.

How Presumptive VA Disability Works

Presumptive disability simplifies the process for veterans to receive VA benefits.

Here’s how it works:

  • #1. Service in a Specific Location: The veteran must have served in a particular location known for hazardous exposures, such as areas with burn pits or other toxic substances.
  • #2. Qualifying Time Period: The veteran’s service must have occurred during a specific time frame when these exposures were known or suspected to occur.
  • #3. Development of a Presumptive Condition: The veteran must have developed a medical condition that is recognized by the VA as being presumptively linked to the exposures in that location and time frame.

What Are the Qualifying Locations for Burn Pit Exposure?

You are presumed to have been exposed to burn pits if you served in these locations:

On or After September 11, 2001:

  • Afghanistan
  • Djibouti
  • Egypt
  • Jordan
  • Lebanon
  • Syria
  • Uzbekistan
  • Yemen
  • The airspace above these locations

On or After August 2, 1990:

  • Bahrain
  • Iraq
  • Kuwait
  • Oman
  • Qatar
  • Saudi Arabia
  • Somalia
  • United Arab Emirates (UAE)
  • The airspace above these locations

If your location isn’t listed, you can still file a claim, but you’ll need additional evidence linking your condition to your service.

What Are Presumptive Conditions for Burn Pit Exposure?

The PACT Act simplifies the claims process by listing 23 presumptive conditions related to burn pit exposure, meaning you don’t need to prove a direct link to service—the VA automatically assumes your condition was caused by your military service.

VA Presumptive Cancers List Due to Burn Pit Exposure:

  • Brain cancer
  • Gastrointestinal cancer (any type)
  • Glioblastoma
  • Head cancer (any type)
  • Kidney cancer
  • Lymphoma (any type)

  • Neck cancer (any type)
  • Pancreatic cancer
  • Reproductive cancer (any type)
  • Respiratory cancer (any type)

VA Presumptive Respiratory and Lung Conditions List Due to Burn Pit Exposure:

  • Asthma (diagnosed after service)
  • Chronic bronchitis
  • COPD (Chronic Obstructive Pulmonary Disease)
  • Chronic rhinitis
  • Chronic sinusitis
  • Constrictive bronchiolitis
  • Emphysema
  • Granulomatous disease

VA Disability Rating for Burn Pits

There is no single VA rating for burn pits or toxic exposure.

Instead, the VA assigns disability ratings based on the specific condition caused by the exposure.

For example, chronic sinusitis, which is a PACT Act presumptive condition, can be rated from 0% to 50%, with breaks at 10% and 30%.

The VA evaluates burn pit and toxic exposure presumptive conditions under 38 CFR, Part 4, the Schedule for Rating Disabilities, with ratings ranging from 0% to 100% based on the diagnostic code and your severity of symptoms.

Simplified Claims Process Under The PACT Act

Instead of needing to gather extensive medical evidence, including Nexus Letters, to prove that their condition was caused by their service, veterans only need to provide their military service records, such as their DD 214, along with relevant medical records, showing they served in an eligible location during the qualifying time.

This streamlined process generally makes it easier and faster for veterans to receive the benefits they deserve!

How to File a VA Disability Claim for Burn Pit Exposure

If you qualify under the PACT Act, follow these steps to file a VA claim:

Step #1: Gather Your Evidence

  • Medical records showing a diagnosed presumptive condition.
  • DD 214 confirming service in eligible locations during the specified time periods.

Step #2: File Your VA Claim

  • By mail or in person at a VA office.

Step #3: Provide Supporting Documentation

  • Upload your medical records.
  • Lay evidence, such as personal statements from family, friends, or fellow veterans.

Step #4: Follow Up

  • Track your claim status on VA.gov.
  • Respond promptly to any requests for additional information.

Pro Tips: Maximize Your PACT Act Benefits

The PACT Act has significantly expanded VA benefits for veterans exposed to burn pits and other toxic hazards.

If you’re eligible, getting approved for a PACT Act-related claim is now easier than ever.

Here are some pro tips to help you maximize your VA benefits under the PACT Act:

  • Medical Diagnosis Required Make sure your military, VA, or private medical records clearly document a diagnosed presumptive condition recognized under the PACT Act.
  • Military Service Records Matter – Your DD 214 must confirm service in a qualifying location during the specified time period to establish eligibility for PACT Act benefits.
  • No Specific “Nexus” RequiredPresumptive conditions eliminate the need to prove a direct “nexus” to your military service, making it easier to get your VA claim approved.
  • High Approval Rates – Nearly 1.5 million PACT Act claims have already been approved, with a 74.5% success rate.
  • Expanded Free VA Healthcare – Eligible veterans can receive free VA healthcare for up to 10 years after separation.
