The VA claims process can be complicated, leading some to consider withdrawing their claim.

But what happens if you withdraw your VA claim? Will it impact your VA disability benefits?

In this post, we’ll break down everything you need to know about withdrawing a VA claim, how it affects your benefits, and how to do it effectively.

WILL WITHDRAWAL OF A VA CLAIM AFFECT VA DISABILITY?

Will Withdrawal of a VA Claim Affect VA Disability?

Withdrawing a VA claim can affect possible new VA disability benefits depending on the claim stage and the withdrawal circumstances. However, withdrawing a claim DOES NOT affect previously approved VA disability benefits.

When you withdraw a claim, you are effectively stopping the VA from making a decision on that specific claim.

This could potentially impact your VA disability benefits, particularly if the withdrawn claim included evidence or arguments that could have supported a higher VA disability rating or service connection for a condition.

What Happens When a VA Claim is Withdrawn?

When you withdraw a VA claim, the VA halts the processing of that claim.

This means:

  • The VA will no longer review or decide on the evidence provided in the withdrawn claim.
  • The claim is removed from consideration.
  • Withdrawal is typically considered final unless you choose to reopen or refile the claim later. Note: You can retract a withdrawal within 30 days of VA notification.

Keep in mind that, depending on the type of claim and the withdrawal circumstances, future VA disability claims for the same condition may require submitting new and material evidence.

HOW LONG DOES IT TAKE TO WITHDRAW A VA CLAIM?

How Long Does It Take to Withdraw a VA Claim?

The process of withdrawing a VA claim is generally straightforward and doesn’t take long.

Once you submit a written request to withdraw the claim, the VA typically processes the request within a few weeks.

However, processing times may vary depending on:

  • The workload at the VA office handling your claim.
  • Whether all necessary documentation is submitted correctly.

Can I Cancel My VA Claim?

Yes, you can cancel your VA claim.

To cancel a VA claim, you must submit a request to the VA that includes your name, claim number, and a clear statement expressing your intention to withdraw the claim.

You can cancel your VA claim:

  • In writing (a signed statement) or
  • Orally (in person or by telephone), or
  • Electronically (by e-mail or through eBenefits or the Stakeholder Enterprise Portal (SEP))

Can I Cancel My VA Claim Online?

Yes, the VA allows you to withdraw your claim online through their eBenefits or VA.gov portal.

Here’s how:

  1. Log in to your VA account on eBenefits or VA.gov.
  1. Navigate to the claim you want to withdraw.
  1. Follow the instructions to submit a withdrawal request electronically.

While online withdrawal is convenient, it is always a good idea to confirm receipt of your request with the VA.

In addition, you may want to keep a copy of your withdrawal request for your records in case of any discrepancies.
